Corporate income tax
Slovenian corporate income tax (CIT) is charged at the standard rate of 25% and is payable by residents, and non-residents operating in Slovenia through a permanent establishment.
Withholding tax is charged on rental payments to a non-resident at the standard rate of 25%. However, the provisions of double tax treaties will be observed.
Capital gains
Capital gains realised by Slovene-resident companies on the disposal of Slovene property and shares in property companies are subject to CIT at the standard rate.
Capital gains realised by non-resident companies on the disposal of Slovene property and shares in property companies are subject to withholding tax at the standard rate, subject to the provisions of any relevant double tax treaty.
Property tax
There is no tax on the value of property held in Slovenia by either resident or non-resident entities.
Property transfer tax
Transfer tax is charged at 2% on the purchase price of the property, if VAT on such transaction has not been levied. This tax is payable by the vendor unless otherwise agreed. Exemptions exist for certain types of property.
VAT
VAT must be charged by any entity (irrespective of residence) when its turnover for the previous 12 months becomes greater than SIT 5million. VAT is generally applicable on the sale of real estate (including land) at the standard rate of 20%. A reduced rate of 8.5% applies on the supply of real estate which will be used for residential purposes until 31 December 2007. Exemptions may apply in certain circumstances, e.g. the supply of “old” real estate (sold after two years from its initial use) is VAT exempt with the option to waive the exemption.
