The Taiwan Income Tax Act does not make a clear distinction between a license transaction and a software sales transaction, often giving rise to uncertainty and disputes over the income tax treatment of cross-border software transactions. However, a ruling issued by the Taiwan Ministry of Finance (MOF) on 9 April 2007 (Ruling 9604520730) clarifies this issue and should help to prevent future disputes involving the tax treatment of cross-border software transactions.
